User Agreement

1. Subject of the Agreement. General Provisions

The administration (hereinafter referred to as “the Administration”), of the website www.leadel.net (hereinafter, “the Site”), shall provide its services on the terms and conditions, being the subject of this User Agreement (hereinafter, “the Agreement”), to the person, who has accepted the terms and conditions hereof, the Privacy Statement (Section 5 hereof) and registered on the Site in accordance with the description specified on the Site (hereinafter, “the User”).

This Agreement may be amended by the Administration at any time without prior notification of the users. The most up-to-date version of the Agreement can be seen at: www.leadel.net/disclaimer

The breach hereof may cause termination of the User’s registration by the Administration unilaterally.

2. Description of the Services

Leadel.net is web-based interactive media service that allows its users to watch, comment on and create on-line media (herein referred to as the "Service"). The Service may be used through a web browser. Once registered with Leadel.net, each User receives his or her own profile on to which they may post text, data, messages, or information concerning or linked to software, music, sound, photography, graphics, and video (“the Content"). This Content may reside on Leadel.net servers or on the servers of a third party.

3. Registration of the User

To use the Site the User shall go through a registration and data confirmation procedure.

As a result of the User’s registration, the User’s account shall be created on the site.

During registration the User shall provide true, accurate and complete information about himself/herself in the corresponding fields. In case of any change in the information after registration, the User shall update the information as soon as possible.

The Administration shall reserve the right to limit access to the Site, if there are reasons to believe that the information provided by the User is not true or up-to-date.

The User shall take due measures to keep secret his/her password to access the Site, as well as his/her other personal data, including such information as e-mail, date of birth etc. The User shall not disclose his/her data to third persons.

It should also be taken into account that the Administration shall never ask the User to provide more information than it is specified on the Site.

4. Registered User’s Conduct

The User shall be fully liable for any actions taken by the User using the User’s account, as well as any consequences, which such use of the User’s account could cause or have caused.

The User shall agree that he/she shall be responsible for the Content uploaded by the User on the Site.

The User shall not use the Site for illegal activity, including, but not limited to, distribution of malware, distribution of content (text, video, audio etc.), being libel, immoral, propagating hatred and/or racial, ethnical, sex, religious, social discrimination of people, containing insults to particular individuals and legal entities, breaching copyright, rights to other intellectual property, otherwise breaching the legislation.

The User shall acknowledge that the Administration may (but shall not be obliged to) preview the Content that the User intends to post on the Site, and prohibit posting it on the Site without any explanations.

The User shall communicate with other users of the Site amicably, unaggressively, shall not insult other users.

The Administration shall reserve the right at its own discretion to refuse uploading or delete any content from the Site, if there are reasons to believe that the content contradicts the legal norms and terms and conditions hereof.

5. Privacy Statement

The Site may be used subject to the compliance with the Privacy Statement. The most up-to-date version of the Privacy Statement can be seen at: www.leadel.net/PrivacyStatement

6. Exemption from Liability

The User shall assume the obligations to hold harmless the Administration from and against any claims of third persons connected with non-compliance with the terms and conditions hereof or breach of any rights of third persons, including copyright, rights to other intellectual property, breach of legal norms.

The User shall agree that he/she shall receive services “as is”.

The Administration shall not give any warranties, express or implied, including, inter alia, a warranty of the quality of the services, their suitability for this or that purpose.

The User shall agree that he or she shall use the Site at its own risk and peril.

The Administration shall not be liable for any direct or indirect losses incurred due to the use or impossibility of the use of the Site by the User.

Should there be any security threat, a threat of breaching any legal norms and a threat of other violations, the User shall inform the Administration in advance to minimize possible negative consequences.

7. Copyright

The Contents of this Site, including but not limited to the Site, design of the Site, all images, video, music, plug-ins, audio and other objects and combinations thereof are the property of the Administration, the Site Users and other right holders and are protected under copyright.

Any User may only send, modify, distribute or reproduce any copyrighted materials, trademarks or any other data or information not legally owned by the User subject to the prior written consent of the respective rights holder.

By posting the User Content on the Site, the User grants other users a non-exclusive right to use such Content by viewing and reproducing it (including copying) as well as other rights solely for private noncommercial use of Content, unless such use prejudices or may prejudice the right holder’s reserved rights.

By posting the User Content on the Site, the User grants to the Administration the free right to use the Content and provide access thereto to the public for no consideration. No remuneration shall be paid to the User because the Site is free of charge and a noncommercial project.

The User agrees that the Administration may post any banners or advertisements on the Site pages with the User’s Content, modify such Content to post any advertisements and use the posted Content for other purposes.

The User must not use the Content unless authorized to do so under the User Agreement or by the author’s/right holder’s explicit prior written consent.

The User agrees to be fully liable for the Content posted by the User to the Site. The Administration does not endorse and is not liable for the Content or its compliance with the law; neither has it assumed any liability for any copyright infringement, unauthorized use of trademarks, names or logos or alleged infringement of any third party rights arising out of such Content. The User shall settle any claims which may arise in connection with the above at its own expense.

The Administration reserves the right to refuse service to the User, provided such User infringed any third party copyright. In this case the User shall be fully liable for any infringement of the third party rights.

Any disputes between the Administration and third parties concerning copyright shall be resolved by pre-trial negotiations.

Any person claiming copyright should send a written request to the Administration. All requests shall be considered without procrastination.

8. Entry into force of the User Agreement

This Agreement shall enter into force upon giving consent by the User to the terms and conditions hereof through clicking by the User of the button “I agree” under the text hereof.

9. Miscellaneous

If any provision hereof contradicts or will contradict the law in the future, the corresponding provision shall not be applied.
